THE ICE MAZE LLC RULES AND WAIVER OF LIABILITY 

FACILITY RULES.  By purchasing a ticket and entering The Ice Maze (the “Facility”), the Buyer(s) agrees to observe all Facility rules, listed below.  The Buyer(s) further acknowledges that the failure to observe all Facility rules may result in injury to Buyer(s) or Buyer(s) being asked to leave the Facility without a refund. 

 

Rules: 

1. All guests must stay on the groomed walking pathways. 

2. Climbing, standing,or sitting on any ice structure is not allowed and may result in significant injury.

3. Running in The Ice Maze is not allowed.

4. Guests may not touch hanging icicles in any manner.

5. Children and minors must be accompanied by an adult who accepts full responsibility for the health, safety, and well being of the accompanying minors and to ensure that minors adhere to Facility Rules.

6. Pets are not allowed in the Facility.

7. Outside Food and Drink is not allowed inside the Facility.

 

CONSENT TO PHOTOGRAPH, FILM, OR VIDEOTAPE.  By purchasing a ticket and entering the Facility, the Buyer(s) consents that photographs and videotapes of the Buyer(s) may be taken, edited, used, and reused by the Releasees in print, on the Internet, and all other forms of media, for any purpose, including, but not limited to, security, media, publishing, promotion, and marketing purposes.

 

IMPORTANT: WAIVER OF LEGAL RIGHTS. By purchasing a ticket and entering The Ice Maze (the “Facility”), the Buyer(s) hereby RELEASES, WAIVES, DISCHARGES, AGREES TO DEFEND and COVENANTS NOT TO SUE The Ice Maze LLC, Alaska State Fair, City of Palmer, and their respective owners, principals, employees, representatives, agents, assigns, affiliates, and subsidiaries (collectively, the “Releasees”) from all claims, demands, losses, damages, liabilities, actions, suits or rights of any kind or nature for any injuries, disabilities, death, mental anguish, pain and suffering and similar or related conditions, or damage to the Buyer(s)’s property or to third parties arising out of, caused by, or resulting in any way from the Buyer(s)’s use of the Facility, with or without an accommodation of Buyer’s disability, if any, and/or on account of first aid or medical treatment provided or the failure to provide first aid or medical treatment, related to my entrance to and activities in the Facility, even if caused in whole or in part by the negligence of the Releasees or otherwise. 

 

The Buyer(s) expressly acknowledges that the Facility contains ice structures, hanging icicles, ice walkways, and other structures, both natural and artificial, that carry known and unknown risks including, but not limited to, bodily injury, permanent paralysis, death, short and long-term disabilities, or damage to the Buyer(s)’s property or to third parties. The Buyer(s) understands and acknowledges that such risks cannot be eliminated or mitigated without jeopardizing the essential qualities of the Facility.

 

I agree to defend, hold harmless and indemnify the Releasees from any claim, liability, loss, damages, expenses, or attorney fees resulting from a claim brought by any other person for injury, death, disability, anguish or property damage caused by my conduct in connection with The Ice Maze and/or that of any members of my family, and all minors on whose behalf this release is signed.

 

Buyer(s) further acknowledges and warrants that Buyer(s) and everyone for whom Buyer(s) has purchased tickets to Facility including accompanying minors carry personal medical insurance and that should Buyer(s) or minors accompanying Buyer(s) become injured at the Facility that such personal medical insurance is sufficient coverage of Buyer(s) and their parties.

 

This Waiver and Release of Liability contains the entire agreement between myself and the Releasees, is a legally binding agreement that will be construed broadly to provide a release and waiver to the maximum extent permitted by law, and is binding on my family members, heirs, successors, assigns, and legal representatives. Any provision of this Waiver and Release of Liability found to be void or unenforceable shall be severed from this agreement and shall not affect the validity or enforceability of other provisions. Any dispute relating to this agreement shall be subject to the exclusive jurisdiction and venue of the State and Federal courts located in Anchorage, Alaska.

 

I have read and voluntarily signed this document and I understand that by signing below, I have given up substantial rights. I acknowledge that, but for the execution of this Waiver and Release of Liability, Releasees would not allow for my admission into the Facility.
